• 1. Payment Terms.
  • 1.1 Purchases of products will be due for payment on or prior to thirty days (30) from the end of the month of supply and ownership will be retained by Dynaweld Industrial Supplies Pty Ltd. in accordance with these Terms & Conditions of Sale.
  • 1.2 Credit facilities may be withdrawn at any time without prior notice in accordance with Dynaweld Industrial Supplies Pty Ltd. Terms & Conditions of Sale.
• 2. Prices. Prices are subject to change without notice. Orders are accepted on the basis that prices charged will be those ruling at the time of delivery.
• 3. Ownership & Retention of Title. Until full payment of clear funds has been made of the price of any goods purchased from Dynaweld Industrial Supplies Pty Ltd. covered by this agreement, and any other sums whatsoever outstanding from the Purchaser to Dynaweld Industrial Supplies Pty Ltd. from time to time covered by this agreement:
  • 3.1 The price shall become immediately due if the purchaser makes default in paying any other sums due to Dynaweld Industrial Supplies Pty Ltd. or if the purchaser shall become bankrupt or commit any act of bankruptcy or compound with its creditors or have judgement entered against it in any court or, being a company, have a provisional liquidator, liquidator, receiver or manager appointed.
  • 3.2. The property in the goods shall not pass to the purchaser and the purchaser shall keep the goods as bailee for Dynaweld Industrial Supplies Pty Ltd. The goods shall nevertheless be at the risk of the purchaser from the time of delivery.
  • 3.3 Dynaweld Industrial Supplies Pty Ltd. is irrevocably authorised to enter any premises where the goods are kept, and to use the name of the purchaser and to act on its behalf, if necessary to recover possession of the goods.
• 4. Risk of loss or damage. The customer shall be responsible for all loss or damage howsoever arising from the time the goods leave the care of Dynaweld Industrial Supplies Pty Ltd. All insurance in respect of the goods shall be the responsibility of the purchaser.
• 5. Change in Customer Details. The purchaser agrees that any change in respect of ownership, legal entity or address be notified immediately.
• 6. Terms and Conditions. The purchaser shall acknowledge receipt of and accept Dynaweld Industrial Supplies Pty Ltd. present standard Terms and Conditions of Sale and acknowledge that the Terms and Conditions may be changed unilaterally from time to time.
• 7. Freight Charges. Are the responsibility of the customer unless otherwise arranged.
• 8. Credit Claims. Must be made within seven (7) days or 20 % restocking fee will be charged. The purchaser is required to obtain authorisation from Dynaweld Industrial Supplies Pty Ltd. to return goods and shall do so using an "Authorisation to Return Goods" form duly signed by Dynaweld Industrial Supplies Pty Ltd. Goods must be shipped as per our instructions. Freight charges will not be accepted if shipped any other way.
• 9. Back Orders. Are accepted and executed on the basis of prices ruling at the date of despatch.
• 10. Indent Orders. Goods ordered on indent are not returnable for credit. Additional Notes: " Where indicated "P.O.A", price or product availability is on application. Please call for pricing or availability. " This price list supersedes all other price lists and pricing. " The information provided in this price list is accurate and reliable, however no warranty of accuracy or reliability is given. No responsibility arises in any other way by errors or omissions. " Pictures shown in this price list are indicative only, products, packaging & unit volumes may vary. " Due to increasing costs from freight companies, a Dangerous goods surcharge may apply to such goods.
